Inheritance law

It is inevitable in life that our loved ones will die and they will not be with us forever;
unfortunately, the time will come (sooner or later) when we have to say goodbye to them and
have to let them go.

The loss of our loved ones is a trauma and a loss in itself, but the process doesn’t stop here. From
a legal perspective, the hard part comes afterwards. Our firm has many years of experience in
this field: we can guide you through the legal process from the beginning to the end.

1. The will

We can freely determine the content of our will; however, even a small issue can invalidate it, so
it is recommended to do estate planning with the assistance of knowledgeable professionals.

There are 3 different types of wills:

  • Authentic will – drafted by a notary
  • Private will – in principle, it does not require a lawyer, but if it is countersigned by a
lawyer, it will be recorded in the register of the Hungarian Bar Association. In this case,
the will won’t be lost or concealed.
  • Oral will (only possible in exceptional, life-threatening and extraordinary cases)

To avoid any misunderstandings later on, our law firm will help you draft your will with the
utmost discretion and with a precise knowledge of the rules and regulations.

2. Inheritance Procedure

The inheritance procedure as well as the probate hearing take place before the competent notary
public based on the deceased’s last address. The estate will be transferred to the heirs by the
competent notary public. The decision may be appealed within 15 days. The heirs can also
pursue their claims at court separately from the inheritance procedure.

Considering that the economic and legal environment rapidly changes nowadays, legal
representation in inheritance matters gradually becomes more and more necessary. The
complexity of inheritance matters, which emphasizes its importance even more. If a dispute
arises in relation to the inheritance, our firm also provides representation in court proceedings.

Thus, it is important to hire an experienced lawyer with our representation, who will act on our
behalf and represent us at the probate hearing and, if necessary, will submit a claim or negotiate
a settlement.

3. Inheritance Litigation

It can happen that the above-mentioned inheritance proceedings do not end as expected. In such
cases, we will always need an experienced lawyer to represent us: firstly, for the precise

knowledge of the law and determining our options, and secondly, to ensure that the proceeding
runs smoothly.
